1. Preamble & Identification
These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between the company Rivearth, hereinafter referred to as "Rivearth", and any person making a purchase on the website www.rivearth.com (hereinafter "the Website"). By confirming an order, the customer fully accepts these GTCS without reservation.
Rivearth is the seller of the products and services listed on the website. The e-commerce website www.rivearth.com is an online store accessible via the Internet, open to any user of this network.
It is operated by the microenterprise RIVEARTH, located at 80 rue Amiral Cellier 83200 Toulon, France, registered in the Trade and Companies Register under the SIRET number 9385327100010.
The manager of the company is Mrs. GAUTHIER Pauline.
The Website offers its products for sale in France and abroad.
The Website is intended for individuals and is prohibited for professionals.
Any use of the Website implies the customer's full and complete acceptance of these GTCS. This acceptance must be full and unreserved; any acceptance with reservations is considered null and void.
In the event of changes to these GTCS, the applicable terms are those in effect at the time of using the services or placing an order.

2. Products
The essential characteristics of the products are presented on the Website in each product description.
The customer is fully informed that the images, photos, and colors of the items for sale may not correspond to the actual colors due to the Internet browser or the screen being used.
The products available for sale on the Website are subject to availability while stocks last.
If one or more ordered items are no longer available, the customer will be informed by email as soon as possible.
The customer may then cancel the order for the affected item(s) and, if applicable, be refunded the amounts already paid, by credit to the bank account corresponding to the credit card used for payment, within a maximum of 30 days. The products remain the property of Rivearth until full payment for each order has been received.
3. Prices
The prices of the products sold on the Website are listed per item and reference and are stated in euros. The prices of the products are those indicated on the Website, regardless of the delivery location, and include all applicable French taxes (VAT included), excluding shipping fees, which are the responsibility of the customer. Any local taxes that may apply to the sale are also the responsibility of the customer.
It is specified that customs duties and any taxes charged upon delivery to certain countries where the products may be shipped are not necessarily included in the prices and are therefore the responsibility of the customer (see information on customs duties).
Any change in the legal VAT rate will automatically be reflected in the prices of the items, as soon as it comes into effect.
The applicable prices are those displayed on the Website at the time of the order.
4. Orders
Placing an order on the Website is subject to following the procedure, which includes successive steps leading to the validation of the order.
The customer can select as many products as they wish, within the normal needs of a consumer.
Order Process:

• Identification and account creation (if necessary)
• Selection of delivery method
• Selection of payment method
• Payment validation
• Receipt of confirmation email
Order Validation:
The order is considered finalized when the customer has confirmed their order and completed the payment. The customer will receive a confirmation email containing a summary of the order and an estimated delivery time.
5. Payment Terms
This is an order with an obligation to pay, meaning that placing the order implies a payment commitment from the buyer.
Payment for products is made by credit card (Visa, MasterCard, American Express), PayPal, or Apple Pay. The customer agrees to pay the full price of the order when validating it.
The buyer guarantees to Rivearth that they have any necessary authorizations to use the payment method they have chosen when confirming the order. Rivearth reserves the right to suspend any order processing or delivery in the event of payment authorization refusal by the official payment organizations or in case of non-payment.
6. Refusal to Process an Order
Rivearth reserves the right to remove any product displayed on the Website at any time and to replace or modify any content or information on it. Despite Rivearth’s best efforts to meet its customers’ expectations, Rivearth may refuse to process an order after sending the customer the confirmation email summarizing the order.
Rivearth cannot be held liable to the customer or any third party for the harmful consequences of removing a product from the Website, replacing or modifying any content or information on this Website, or refusing to process an order after sending the confirmation email summarizing the order.
Rivearth also reserves the right to refuse or cancel an order from a customer with whom there is a dispute over payment for a previous order, who has acted in violation of these GTCS, in the case of suspicious returns of products, or more generally in the event of objective suspicion of fraud.
Rivearth strictly prohibits the use of its Website for professional purposes, particularly for the purpose of purchasing products for resale. As a result, Rivearth reserves the right to refuse an order placed by a professional or a person clearly acting for professional purposes, especially if the quantity of items ordered exceeds the normal needs of a consumer.
7. Shipping Fees and Customs Fees
Shipping fees are the responsibility of the customer and are calculated based on the delivery address provided by the customer. These fees vary depending on the geographical area and the weight of the package.
For residents outside the European Union, additional customs fees related to the shipment of the order may apply and will be borne by the customer.
To address this, the customer should write to hello@rivearth.com, providing the order reference and attaching the issued invoice.
8. Right of Withdrawal & Returns
Rivearth does not offer exchanges.
Rivearth encourages the customer to return the item and place a new order, subject to availability.
In accordance with Article L.221-18 of the French Consumer Code, the customer has a period of 14 days from the receipt of the order to exercise their right of withdrawal from Rivearth, without needing to provide any reason. After this 14-day period, the sale is final and binding.
To exercise this right of withdrawal, the customer must notify Rivearth of their decision to withdraw, before the expiration of the 14-day period, by sending an email to hello@rivearth.com, including the following information: order number, name, address, item name(s), price, quantity, and reason(s) or by feeling a Withdrawal form.
Without prejudice to the withdrawal right under the Consumer Code, Rivearth also offers the customer an additional 15-day period from the date of receipt of the order to return the product(s) and obtain a refund corresponding to the amount already paid.
Any item returned incomplete, damaged, washed, or stained will not be accepted. In such cases, a refund will not be issued.
In the case of returning the entire order, any products received as a gift must also be returned.
8.1 Making a Return
The customer has a period of 15 calendar days after receiving their order to make a return.
Before making any return, the customer must inform customer service by logging into their account and submitting a return request by filling out the return form on the Website.
Returns are at the customer’s expense and should be sent to the following address:

The customer must ensure they keep the tracking number in order to monitor the return shipment until it reaches Rivearth. Upon receiving the returned product, Rivearth will process it within 3 to 15 business days, and a confirmation email will be sent to the customer.
8.2 Refund Period
The customer's return package will be processed within 3 to 15 business days after receipt. The refund will be issued to the bank account of the card used to pay for the order.
The return package processing will be confirmed by email to the customer. From the confirmation email, the refund will be processed within 5 to 10 business days.The refunded amount corresponds to the value of the products returned in perfect condition and does not include shipping fees, which are the responsibility of the customer.
If the customer used a discount code during their order, the discount will not be refunded following the return.
8.3 Responsibility and Sending Your Return Package
As long as Rivearth has not received the return package, it remains the responsibility of the customer. In case of loss or any other issue during the shipping of the return package, Rivearth advises the customer to contact the carrier used for the shipment. The customer should also inform Rivearth at hello@rivearth.com.
Rivearth cannot confirm the return of the customer's items until the package has arrived at its premises. It is recommended that the customer keeps proof of postage for the duration of the processing.
8.4 Refusal of Return
The customer’s return request may be refused in two cases:
• If the return period has expired
• If the customer’s item does not meet the return conditions detailed above on this page. Each product is inspected upon receipt.
9. Warranties
The products benefit from conformity warranties and warranties against hidden defects. Without prejudice to the withdrawal period outlined in Article 9, in the event that the delivered items do not conform in nature or quality to the specifications stated in the delivery slip, the customer must inform Customer Service by writing to hello@rivearth.com.
They will then receive return instructions by email.The product must be returned in brand-new condition, in its original packaging, and accompanied by the delivery slip, to the address indicated on the return label.
10. Liability
Rivearth cannot be held liable for indirect or unforeseeable damages resulting from the use of the products sold on the Website. Rivearth’s liability is limited to the amount of the order in question.
10.1 Protection of Personal Data
In accordance with the "Data Protection and Freedom" law and the GDPR, the personal data collected during the order process is intended for Rivearth for customer relationship management and order fulfillment. The customer has the right to access, correct, delete, and object to the processing of their personal data by contacting customer service at hello@rivearth.com.
10.2 Governing Law and Dispute Resolution
These General Terms and Conditions of Sale are governed by French law. Any dispute related to the execution of these terms will be under the exclusive jurisdiction of the French courts.
If the customer encounters difficulties during the order process or delivery of Rivearth products and believes their rights as a consumer have not been respected, they may send a written complaint to the email address hello@rivearth.com to seek an amicable resolution of the dispute directly with Rivearth.
In the event that the complaint is not resolved amicably by Customer Service within one year, the customer may use the free mediation service. They can also contact the online dispute resolutionplatform provided by the European Commission at the following address: http://ec.europa.eu/consumers/odr/.
The use of mediation by the customer is an alternative mechanism that does not constitute a prerequisite for initiating legal action.
11. Intellectual Property Rights
All products, as well as texts, comments, photos, trademarks, graphics, concepts, illustrations, images, and logos on the Website, are the exclusive property of Rivearth and are protected by intellectual property rights in France and worldwide.
Any total or partial reproduction of these elements or the Website is strictly prohibited.
